NIGC compiling list of post-1934 recognized tribes

In the wake of the U.S. Supreme Court decision in Carcieri v. Salazar, the National Indian Gaming Commission is drawing up a list of tribes that gained federal recognition after 1934.

The decision restricts the land-into-trust process to tribes that were "under federal jurisdiction" in 1934. NIGC Chairman Phil Hogen believes the court was "wrong" but said a list will determine how to address the ruling.

"In terms of preparing a list, it seems to me to make sense to make a list of those tribes recognized after 1934 just to find out what that universe is,” Hogen told Indian Country Today.

The National Indian Gaming Association isn't convinced. Tribal leaders say Hogen, a Bush nominee, should resign, citing his lack of consultation on key issues.
