Land-into-trust case awaits Supreme Court action
Tuesday, January 13, 2009

The U.S. Supreme Court will take up a land-into-trust case during its closed-door conference on Friday.

Consideration of Michigan Gambling Opposition v. Kempthorne could mean a decision in a closely-related case is coming this week. The justices heard Carcieri v. Kempthorne in October and the ruling is likely to affect the Michigan case, according to the Turtle Talk blog.

Both cases involve a challenge to the land-into-trust provisions of the Indian Reorganization Act and whether they apply to tribes that weren't recognized as of 1934.
