Court asks Norton for brief in contempt case

The D.C. Circuit Court of Appeals has ordered Secretary of Interior Gale Norton to submit a response to the Indian trust fund plaintiffs who want to reinstate contempt charges against the Department of Interior.
A three-judge panel of the court cleared Norton and former assistant secretary Neal McCaleb in a July 18 decision.
But the plaintiffs, led by Blackfeet banker Elouise Cobell, have asked for a full panel of judges to rehear the case.
Norton's response is due early next month. After the brief is submitted, the court will decide whether or not to rehear the case.
The court currently has nine active judges, five Republican appointees and four Democrat.
